Terms of Use

These terms are an agreement between you and PlayChannel Inc., 5 Brewster St #508, Glen Cove, NY 11542, United States ("we", "us"), which operates the Play To Win brand, for the Play To Win Daily app and website ("the service"). By creating an account or using the service, you agree to them. If you don't agree, please don't use the service.

Who can use it

  • You must be 18 or older to use the service.
  • Golden Word prizes are available only where the Golden Word Official Rules allow.

Your account

  • Playing without an account: you can play a limited set of each day's games as a guest, on one device. A guest that isn't used for 90 days is removed, with any tokens earned as a guest.
  • Creating an account: sign in with email, Apple or Google. A free account plays the same limited set and can claim Golden Word prizes; a subscription opens every game and level.
  • Accurate information: give accurate information, keep your sign-in secure, and tell us if someone else uses your account.
  • One person per account: you may link several sign-ins (email, Apple, Google) to your account; linking a sign-in that already has its own Daily account merges the two into one. Don't share an account or create several to get extra trials, tokens, guesses or prizes.
  • Getting back in: if you can't sign in, or your subscription doesn't show on a new device, use Restore Purchases in the app or email support@playtowingames.net and we will help you recover your account and subscription.

Subscription and free trial

  • What you see before you buy: the price, any free trial, the renewal period and any taxes are shown in the Apple App Store or Google Play purchase screen before you confirm. In the US the subscription is currently $5.99 a month or $49.99 a year; prices vary by country.
  • Free trial: where offered, a new subscriber gets a 7-day free trial. Trial eligibility is decided by Apple or Google (usually one trial per store account).
  • Payment and renewal: Apple or Google bills you, and their terms apply. The subscription renews automatically until you cancel it in your App Store or Google Play subscription settings, following that store's rules on when to cancel to avoid the next charge.
  • After you cancel: you keep access until the end of the period you paid for.
  • If a renewal payment fails: you keep access during the store's grace period, if it offers one; after that, access pauses while the store retries, and ends if payment isn't made.
  • Refunds: Apple or Google decides refunds under their policies. If a payment is refunded, access ends.
  • Deleting your account does not cancel your subscription. Cancel it with Apple or Google.

Tokens, stars and saved games

  • Tokens and stars are game features, not prizes. They have no cash value, can't be bought with money today, can't be sold, transferred or exchanged for money, and are not your property. We may change how they are earned or used, or reset them.
  • Tokens never affect the Golden Word: they can't create a Golden Word guess, add one, or improve your chance of winning a prize.
  • Unused tokens expire: if you don't sign in, earn or spend tokens for 2 years, your token balance and its history are deleted. Signing in at any time before then keeps them for another 2 years.
  • Saved games: a game in progress saved to your account (cloud saves) is kept for 180 days after that day's puzzle, then deleted.

The Golden Word

The Golden Word and its prizes are governed by the Golden Word Official Rules (playtowindaily.com/golden-word-rules). Where the Official Rules and these terms differ on eligibility, entry, odds, prizes, claims or disputes about the Golden Word, the Official Rules control.

  • We may withhold or reverse prizes won through cheating, errors or breaking the rules, as the Official Rules explain.
  • An unclaimed prize is lost if you delete your account.

Playing fair

You agree not to:

  • use bots, scripts, automation or modified apps to play, claim results or earn tokens or prizes;
  • reverse engineer, decompile, tamper with or interfere with the app, its servers or its security checks, except where the law expressly allows it;
  • send false results, exploit bugs, or share answers to gain an unfair advantage in prize play;
  • create several accounts to get around limits, trials or prize rules;
  • use a public name that is offensive or impersonates someone;
  • use the service for anything unlawful, or to harass or harm anyone.

What we do: we check results automatically, and a person reviews anything flagged. If we have reasonable grounds, based on our records, to believe you broke these rules, we may limit, suspend or close your account, and remove the tokens, stars, rankings or prizes involved. We act in good faith and don't act on automated flags alone.

Appeals: if we take action on your account, you can email support@playtowingames.net within 30 days to ask us to look again. A person will review it and reply.

Our content

  • Ownership: the app, games, puzzles, artwork and text belong to us or our licensors, and we license them to you for personal, non-commercial use while you follow these terms.
  • Chess puzzles: some chess puzzles come from the Lichess database, which is public domain (CC0).
  • Copyright complaints: if you believe something in the service infringes your copyright, email support@playtowingames.net with the work, where it appears, and your contact details.

Changes and availability

  • We may change, add or remove games and features.
  • The service may sometimes be unavailable.
  • If we make important changes to these terms, we will tell you in the app or by email before they take effect. Continuing to use the service means you accept them.

Disclaimers

The service is provided "as is" and "as available". To the extent the law allows, we make no warranties, including that it will be uninterrupted or error-free. Some places don't allow these exclusions, so they may not all apply to you.

Limitation of liability

To the extent the law allows:

  • we are not liable for indirect, incidental, special or consequential damages, or for lost data or profits;
  • our total liability for any claim is limited to the greater of the amount you paid for the service in the 12 months before the claim, or $50.

Nothing here limits liability that can't be limited by law, your rights as a consumer, or our obligation to award a prize you won under the Golden Word Official Rules.

Ending your use

  • You: you can stop using the service and delete your account at any time (Settings › Account, or playtowindaily.com/delete-account).
  • Us: we may suspend or end your access if you break these terms, as described in "Playing fair".
  • What continues: the sections on tokens, content, disclaimers, liability and governing law continue after that.

Governing law and disputes

These terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Nassau County, New York, and you and we agree to their jurisdiction. If you live in a place whose consumer laws give you more protection, or let you bring a claim in your local courts, those rights still apply.

App store terms

  • Apple: if you got the app from the App Store, these terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance, is not responsible for the app or any claims about it, and is a third-party beneficiary of these terms who may enforce them.
  • Google: if you got the app from Google Play, Google's Play Terms of Service also apply to your use of Google Play. Google is not responsible for the app.
